PROFESSIONAL MISCONDUCT
If you are aggrieved by a professional or licensing decision made by a regulatory body, you may have the right to apply for a review of that decision to the Victorian Civil and Administrative Tribunal (VCAT).
A review hearing is not an appeal against the original decision. On the hearing of a review, VCAT stands in the shoes of the original decision-maker and will hear and determine the matter afresh.
In some cases, VCAT may be responsible for hearing and determining certain matters at first instance.
Our firm represents clients seeking to review decisions by the following bodies:
Business Licensing Authority in relation to a range of occupations including estate agents and motor car traders
Australian Health Practitioners Regulation Agency (AHPRA) concerning health practitioners including doctors, physiotherapists, psychologists and Chinese medicine practitioners
Racing Appeals and Disciplinary Board
Victorian Institute of Teaching
Secretary to the Department of Justice and Community Safety concerning the refusal of Working With Children Checks (WWCC)
Victorian Commission for Gambling and Liquor Regulation (VCGLR)
Victorian Taxi Directorate concerning driver accreditation, taxi licences and commercial passenger vehicle licences
We also act on behalf of members of the legal profession in applications by the Victorian Legal Services Commissioner concerning allegations of professional misconduct.
